NOTICE IS HEREBY GIVEN pursuant to the Partial Summary Judgment of foreclosure dated April 4, 2024, and entered in Case No. 2023CA003918CAAXWS of the Circuit Court of the Sixth Judicial Circuit, in and for on Pasco County, Florida, wherein Capital City Bank is the Plaintiff and AVCO Materials and Services, Inc., a Florida corporation; Edward J. Avella, as Trustee of the Edward J. Avella Trust Agreement dated April 24, 2008, a/k/a
Edward J. Avella as Trustee of the Edward J. Avella Living Trust Agreement dated April 24, 2008 and Edward J. Avella, individually, is the Defendants, that the Pasco County Clerk of Court will sell to the highest and best bidder for cash, in accordance with Chapter 45, Florida Statutes, using the following method: by electronic sale beginning at 11:00 a.m. Eastern Standard Time on May 2, 2024 at http://www.pasco.real foreclose.com, the following described real property as set forth in said Final Judgment:
The South 253.98 feet of Tract 12, Port Richey Land Company Subdivision of Section 33, Township 24 South, Range 16 East, and the North 244.1 feet of Tract
33, Port Richey Land Company Subdivision of said Section 33, as shown on the plat recorded in Plat Book 1, Pages 60 and 61, Public Records of Pasco County,
Florida: less right-of-way for State Road No. 55 Section 14030. (US Highway No. 19) as it is now established, and being more particularly described as follows:
Commence at the concrete monument located at the intersection of the Northly right-of-way line of Pelican Lane with the Easterly right-of-way line of Pelican Lane with the Easterly right-of-way line of Delmar Drive as shown on the Plat of Vista-Del-Mar Unit Two recorded in Plat Book 6, Page 144, of the Public Records of Pasco County, FL; thence run along the Easterly right-of-way line of said Delmar Drive, the same being the West line of said Tract 33, North 00 1’10” East, a distance of 201.14 feet to a point 244.10 feet South of the North line of the Southeast 1/4 of said Section 33 for a point of beginning: the North line of the Southeast 1/4 of said Section 32 being the same as the boundary line between said Tracts 12 and 33; thence continue along the Easterly right-of-way of said Delmar Drive, North 0 01’10” East, a distance of 498.08 feet, South 89 5’51” East, a distance of 331.80 feet to the Westerly right-of-way line of said State Road No. 55 as it is established; thence along the Westerly right-of-way of said State Road No. 55, a distance of 312.18 feet along the arc of a curve to the left, said curve having a radius of 5861.58 feet and a chord of 312.15 feet which bears South 5 02’39” West; thence North 86 28’54” West, a distance of 8.00 feet; thence continue along the Westerly right-of-way line said State Road No. 55 a distance of 187.82 feet along the arc of the curve to the left, said curve having a radius of 5869.58 feet and a chord of 187.82 feet which bears South 2 36’06” West, thence parallel with the North line of the Southeast 1/4 of the Southeast 1/4 of Section 33, North 89 59’51” West, a distance of 288.01 feet to the point of beginning.
