NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment filed May 7, 2010, entered in Civil Case No.: 08CA-11631, of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein U.S. BANK N.A., IN ITS CAPACITY AS TRUSTEE FOR THE REGISTERED HOLDERS OF HOME EQUITY ASSET TRUST 2005-5, HOME EQUITY PASS-THROUGH CERTIFICATES, SERIES 2005-5 is Plaintiff, and JON C. FREDERICK; UNKNOWN SPOUSE OF JON C. FREDERICK; MIDLAND FUNDING LLC; UNKNOWN TENANT #1; UNKNOWN TENANT #2; ALL OTHER UNKNOWN PARTIES CLAIMING INTERESTS BY, THROUGH UNDER, AND AGAINST A NAMED DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAME UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS, are Defendants.
I will sell to the highest bidder for cash at 9:00 a.m. online at www.lee.realforeclose.com on the 1 day of September, 2011 the following described real property as set forth in said Final Summary Judgment, to wit:
LOT 7 AND 8, BLOCK 2678 OF UNIT 37, OF CAPE CORAL SUBDIVISION, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 17, PAGES 15 THROUGH 29, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA 33993.

This property is located at the Street address of: 524 Northwest 3rd Lane, Cape Coral, Florida 33993.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within sixty (60) days after the sale.
