notice is hereby given pursuant to a Final Summary Judgment of Foreclosure dated September 14, 2010 and an Order Rescheduling Foreclosure Sale dated July 25th, 2011, entered in Civil Case No.: 09-5737 CA of the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida, wherein US BANK NATIONAL ASSOCIATION AS TRUSTEE ON BEHALF OF GSAA HOME EQUITY TRUST 2007-3, Plaintiff, and william h. hollenbeck a/k/a william hayes hollenbeck, mortgage ELECTRONIC REGISTRATION SYSTEMS INC., ACTING SOLELY AS NOMINEE FOR COUNTRYWIDE HOME LOANS, INC., THE COTTAGES AT NAPLES BAY RESORT CONDOMINIUM ASSOCIATION, INC., are Defendants.
I will sell to the highest bidder for cash, in the atrium on the first floor of the Collier County Courthouse Annex, 3315 Tamiami Trail East, Naples, FL 34112, at 11:00 AM, on the 22 day of August, 2011, the following described real property as set forth in said Final Summary Judgment, to wit:
UNIT E-106 OF THE COTTAGES AT NAPLES BAY RESORT, A CONDOMINIUM, (THE “CONDOMINIUM”) ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF (THE “DECLARATION”) RECORDED IN OFFICIAL RECORDS BOOK 4121, AT PAGES 3210 THROUGH 3362, INCLUSIVE, OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA, AS AMENDED, TOGETHER WITH THE FOLLOWING (1) EXCLUSIVE RIGHT TO USE THE LIMITED COMMON ELEMENTS APPURTENANT TO UNIT E-106; AND (2) THE UNDIVIDED SHARE OF THE COMMON ELEMENTS OF THE CONDOMINIUM, DECLARED IN THE DECLARATION TO BE APPURTENANT THERETO.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
