NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment of Foreclosure filed September 04, 2009 and an Order Rescheduling Foreclosure Sale filed August 3, 2011, entered in Civil Case No.: 09-CA-58795 (H) of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein the bank of new york mellon, as successor indenture trustee under novastar mortgage funding trust, series 2006-1, Plaintiff, and paulette estime, adams homes of northwest florida, inc., are Defendants.
I will sell to the highest bidder for cash, on the Public Auction website of Lee County, www.lee.realforeclose.com, at 9:00 AM, on the 2 day of September, 2011, the following described real property as set forth in said Final Summary Judgment, to wit:
lots 21, 22 and 23, block 2957, cape coral subdivision, unit 42, according to the plat thereof, as recorded in plat book 17, pages 32 through 44, of the public records of lee county, florida.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
