NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment of Foreclosure filed October 22, 2010 and Order Rescheduling Foreclosure Sale filed August 9, 2011, entered in Civil Case No.: 10-CA-56676 (I) of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein the bank of new york mellon, as successor trustee under novastar mortgage funding trust, series 2006-3, Plaintiff, and marie julie pierre, Mortgage Electronic Registration Systems, Inc., are Defendants.
I will sell to the highest bidder for cash, Beginning 9:00 AM at www.lee.realforeclose.com in accordance with chapter 45 Florida Statutes on the 8 day of September, 2011, the following described real property as set forth in said Final Summary Judgment, to wit:
lots 9 and 10, block 3872, cape coral subdivision, unit 53, as recorded in plat book 19, pages 64 through 78, of the public records of lee county, florida.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
