NOTICE OF SHERIFF'S SALE
Notice is hereby given that pursuant to a Writ of Execution issued in Pasco County, Florida, on the 28th day of June, 2011, in the cause wherein CATHERINE A. GARDNER, was plaintiff and PAUL A. GARDNER, was defendant, being case number 512011CA1506WS in said Court.
I, CHRIS NOCCO, as Sheriff of Pasco County, Florida, have levied upon all the right, title and interest of the defendant, PAUL A. GARDNER in and to the following described property, to wit:
Defendant is the owner of the REVERSION interest in real property as a result of the granting of a life estate to one NOREEN GARDNER as recorded in the official records in and for PASCO COUNTY (Official Records book 8505 at Page 529). In granting the Life Estate to Noreen Gardner, Defendant, Paul A. Gardner retained a reversion interest in the property located at: 7009 Oakwood Drive, New Port Richey, FL 34652. (Parcel ID: 32-25-16-0500-00000-0191)
Therefore the property subject to execution by levy is the REVERSION INTEREST in the real property located at 7009 Oakwood Drive, New Port Richey, FL 34652, as also known by the legal description described as follows:
The Southerly portion of Lot 19, TIMBER WOODS SUBDIVISION, according to the plat thereof as recorded in Plat Book 15, Pages 8 and 9, of the Public Records of Pasco County, Florida, being further described as follows: Commence at the Southwest corner of said Lot 19 for a Point of Beginning, thence run along the west line of said Lot 19, North 00 degrees 06 minutes 38 seconds East, a distance of 95.89 feet, thence run North 86 degrees 02 minutes 24 seconds East, a distance of 71.09 feet, thence North 64 degrees 43 minutes 16 seconds East, a distance of 20.69 feet to the westerly right of way of Oakwood Drive, thence run Southeasterly along said right of way Oakwood Drive along the arc of a curve to the right a distance of 14.78 feet, said curve having a radius of 45.00 feet, a central angle of 18 degrees 48 minutes 54 seconds and a chord bearing and distance of South 35 degrees 22 minutes 44 seconds East, 14.71 feet to the Southeast corner of said Lot 19, thence along the Southeasterly line of said Lot 19 South 45 degrees 13 minutes 02 seconds West, a distance of 138.61 feet to the Point of Beginning.
I shall offer this property for sale “AS IS” on the 20th day of Septembber, 2011, at PASCO SHERIFF'S OFFICE WEST OPERATIONS, 7432 LITTLE RD, in the City of NEW PORT RICHEY, County of Pasco, State of Florida, at the hour of 10:00 a.m., or as soon thereafter as possible. I will offer for sale all of the said defendant's, PAUL A. GARDNERS', right, title and interest in aforesaid property at public outcry and will sell the same, subject to all prior liens, encumbrances and judgments, if any, to the highest and best bidder or bidders for CASH, the proceeds to be applied as far as may be to the payment of costs and the satisfaction of the above described execution.
