NOTICE IS HEREBY GIVEN pursuant to the Uniform Final Judgment of Foreclosure entered in the above captioned case, that I will sell the following property situated in Manatee County, Florida, described as:

PARCEL 1:
Lot 1, FLORIDA EXCEL SUBDIVISION, as recorded in Plat Book 20, pages 77 and 78, Public Records of Manatee County, Florida.
Together with a 35 foot wide non-exclusive perpetual easement for ingress, egress, construction, installation, maintenance and operation of utility facilities recorded in OR Book 966, page 122, Public Records of Manatee County, Florida, through and across real property described as follows:
Begin at the intersection of the North line of the SW 1/4 of Section 23, Township 35 South, Range 17 East, Manatee County, Florida, and the West right-of-way line of the Tamiami Trail (U.S. 41); thence Southerly along said West right-of-way line, a distance of 1068 feet to a point, said point being the intersection of the North right-of-way of a 50 foot road known as Estes Road and the West right-of-way line of the Tamiami Trail (U.S. 41); thence Westerly and parallel to the North line of the said SW 1/4, a distance of 377 feet for a POINT OF BEGINNING; thence continue Westerly and parallel to the North line of the said SW 1/4, a distance of 35 feet; thence Northerly and parallel to the West right-of-way line of the Tamiami Trail (U.S. 41), 270 feet; thence Easterly and parallel to the North line of the said SW 1/4, a distance of 35 feet; thence Southerly 270 feet to the POINT OF BEGINNING; LESS any portion thereof dedicated to Manatee County for road.
Being a part of Lot 2, FLORIDA EXCEL SUBDIVISION, as recorded in Plat Book 20, pages 77 and 78, Public Records of Manatee County, Florida.

Begin at the intersection of the North line of the SW 1/4 of Section 23, Township 35 South, Range 17 East, Manatee County, Florida, and the West right-of-way line of the Tamiami Trail (U.S. 41); thence Southerly along said West right-of-way line, a distance of 1068 feet to a point, said point being the intersection of the North right-of-way of a 50 foot road known as Estes Road and the West right-of-way line of the Tamiami Trail (U.S. 41); thence Westerly and parallel to the North line of the said SW 1/4 of Section 23, Township 35 South, Range 17 East, a distance of 759 feet for a POINT OF BEGINNING; thence continue Westerly and parallel to the North line of the said SW 1/4 of Section 23, Township 35 South, Range 17 East, a distance of 240.25 feet; thence Northerly and parallel to the West right-of-way line of the Tamiami Trail (U.S. 41), 155 feet; thence Easterly and parallel to the North line of the said SW 1/4 of Section 23, Township 35 South, Range 17 East, a distance of 240.25 feet; thence Southerly 155 feet to the POINT OF BEGINNING, LESS any portion thereof deeded to Manatee County for road right-of-way in OR book 1029, page 2954, Public Records of Manatee County, Florida.
at a public sale, to the highest and best bidder for cash, via Internet: www.manatee.realforeclose.com, at 11:00 a.m. on October 25, 2011. The highest bidder shall immediately post with the Clerk, a deposit equal to 5% of the final bid. the deposit must be cash or cashier's check payable to the Clerk of the Circuit Court. Final payment must be made on or before 5:00 p.m. of the date of the sale by cash or cashier's check. if you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. if you fail to file a claim, you will not be entitled to any remainging funds. after 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
