NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment of Foreclosure filed March 24, 2009 and an Order Rescheduling Foreclosure Sale filed November 15, 2011 entered in Civil Case No.: 08-CA-55127 (H) of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein THE BANK OF NEW YORK MELLON, AS SUCCESSOR TRUSTEE UNDER NOVASTAR MORTGAGE FUNDING TRUST 2005-2, Plaintiff, and CHERYL D. ALEXANDER, INTERNATIONAL FIDELITY INSURANCE COMPANY, are Defendants.
I will sell to the highest bidder for cash, on the Public Auction website of Lee County, www.lee.realforeclose.com, at 9:00 AM, on the 5 day of January, 2012, the following described real property as set forth in said Final Summary Judgment, to wit:
LOTS 29 AND 30, BLOCK 328, UNIT 8, CAPE CORAL SUBDIVISION, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 13, PAGES 1 THROUGH 6, INCLUSIVE, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
