Notice is hereby given that, pursuant to an Order Rescheduling Foreclosure Sale dated November 15, 2011, entered in Civil Case Number 2008-CA-008220, in the Circuit Court for Sarasota County, Florida, wherein U.S. BANK NATIONAL ASSOCIATION AS TRUSTEE FOR CSFB ARMT 05-12 is the Plaintiff, and MARC FONTES, et al., are the Defendants, Sarasota County Clerk of Court will sell the property situated in Sarasota County, Florida, described as:
BEGIN AT THE INTERSECTION OF THE SOUTH LINE OF FRUITVILLE ROAD (66 FEET WIDE) AND THE EAST LINE OF THE NORTHEAST 1/4 OF THE SOUTHWEST 1/4 OF SECTION 22, TOWNSHIP 36 SOUTH, RANGE 18 EAST; THENCE SOUTH 0° 13` WEST ALONG THE EAST LINE OF THE NORTHEAST 1/4 OF THE SOUTHWEST 1/4, 1113.78 FEET; THENCE NORTH 89° 47` WEST, 50 FEET TO THE POINT OF BEGINNING; THENCE SOUTH 89° 28`30” WEST, 310.5 FEET TO THE EAST RIGHT-OF-WAY LINE OF DRAINAGE CANAL NO. 34-A OF SARASOTA-FRUITVILLE DRAINAGE DISTRIC; THENCE NORTH 41° 00` EAST ALONG SAID RIGHT-OF-WAY, 218.97 FEET; THENCE NORTH 1° 40` EAST ALONG SAID RIGHT-OF-WAY 51.15 FEET; THENCE EAST AND PARALLEL TO FRUITVILLE ROAD, 166.1 FEET; THENCE SOUTH 0°13` WEST, PARALLEL TO AND 50 FEET WEST OF SAID EAST LINE OF THE NORTHEAST 1/4 OF THE SOUTHWEST 1/4 213.8 FEET TO THE POINT OF BEGINNING; LYING AND BEING IN THE NORTHEAST 1/4 OF THE SOUTHWEST 1/4 OF SECTION 22, TOWNSHIP 36 SOUTH, RANGE 18 EAST.
ALSO, THE EASTERLY 35 FEET OF THE SAID RIGHT-OF-WAY OF SAID SARASOTA-FRUITVILLE DRAINAGE DISTRICT, WHICH RIGHT-OF-WAY LIES IMMEDIATELY WEST OF AND ADJACENT TO THE WESTERLY BOUDNARY OF THE LAND HEREIN ABOVE DESCRIBED, WHICH 35 FOOT STRIP OF LAND IS SUBJECT TO THE EASEMENT OF SARASOTA-FRUITVILLE DRAINAGE DISTRICT OVER SAME WHICH HAS BEEN RESERVED IN SAID SARASOTA-FRUITVILLE DRAINAGE DISTRICT AS A CANAL RIGHT-OF-WAY FOR DRAINAGE PURPOSES.

BEGIN AT THE INTERSECTION OF THE SOUTH LINE OF FRUITVILLE ROAD (66 FEET WIDE) AND THE EAST LINE OF THE NORTHEAST 1/4 OF THE SOUTHWEST 1/4 OF SECTION 22, TOWNSHIP 36 SOUTH, RANGE 18 EAST; THENCE SOUTH 0° 13` WEST, ALONG THE EAST LINE OF SAID NORTHEAST 1/4 OF THE SOUTHWEST 1/4, 1113.78 FEET; THENCE NORTH 89° 47` WEST, 50 FEET TO THE POINT OF BEGINNING; THENCE SOUTH 89° 47` EAST, 25 FEET; THENCE NORTH 0°13` EAST 213.8 FEET; THENCE NORTH 89°47` WEST 25 FEET; THENCE SOUTH 0°13` WEST, 213.8 FEET TO THE POINT OF BEGINNING.
TOGETHER WITH AN EASEMETN FOR INGRESS AND EGRESS OVER BEARDED OAKS DRIVE TO FRUITVILLE ROAD.
ALL LYING AND BEING IN SARASOTA COUNTY, FLORIDA.
at public sale, to the highest and best bidder, for cash, at www.Sarasota.realforeclose.com at 9:00 AM, on the 20th day of December, 2011. Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
