NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale filed the 2 day of December, 2011, and entered in Case No. 36-2009-CA-061500, of the Circuit Court of the 20TH Judicial Circuit in and for Lee County, Florida, wherein BAC HOME LOANS SERVICING, L.P. F/K/A COUNTRYWIDE HOME LOANS SERVICING, L.P. is the Plaintiff and JAMES K. BANKS; ONEWEST BANK, FSB F/K/A INDYMAC BANK, FSB; THE ESTATES AT ESTERO RIVER COMMUNITY ASSOCIATION, INC.; CAROLE M. BANKS; UNKNOWN TENANT (S); JOHN DOE; JANE DOE AS UNKNOWN TENANT (S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash at the, www.Lee.realforeclose.com, 9:00 AM on the 5 day of January, 2012, the following described property as set forth in said Final Judgment, to wit:
LOT 59, ESTATES AT ESTERO RIVER, A SUBDIVISION ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 76, PAGE 82 THROUGH 85, INCLUSIVE, PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
