NOTICE IS HEREBY GIVEN pursuant to an Order rescheduling foreclosure sale filed December 5, 2011 entered in Civil Case No. 08-CA-050514the Circuit Court of the 20th Judicial Circuit in and for Lee County, Florida, wherein The Bank of New York Mellon f/k/a The Bank of New York, as Trustee for the Certificateholders CWALT, Inc. Alternative Loan Trust 2006-OC10, Mortgage Pass-Through Certificates, Series 2006-OC10, Plaintiff and Denis C. Everest a/k/a Denis Everest and Zaccha Everest a/k/a Z. Everest are defendant(s), I will sell to the highest and best bidder for cash BEGINNING 9:00 A.M. AT WWW.LEE.REALFORECLOSE.COM IN ACCORDANCE WITH CHAPTER 45 FLORIDA STATUTES, January 5, 2012, the following described property as set forth in said Final Judgment, to-wit:
CONDOMINIUM UNIT NO. 521, BUILDING 05, OF ROYAL GREENS AT GATEWAY CONDOMINIUM, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, AS RECORDED UNDER CLERK'S FILE NO. 2006-00154122 OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA. TOGETHER WITH ALL APPURTENANCES THERETO, AND AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS OF THE SAID CONDOMINIUM.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
