NOTICE IS HEREBY GIVEN pursuant to an Order rescheduling foreclosure sale filed December 5, 2011 entered in Civil Case No. 2008 CA 019908 of the Circuit Court of the 20th Judicial Circuit in and for Lee County, Florida, wherein The Bank of New York Mellon F/K/A The Bank of New York, as trustee for the benefit of the certificateholders of CWABS, Inc. Asset-Backed Certificates, Series 2007-9, Plaintiff and Marquette Ellis are defendant(s), I will sell to the highest and best bidder for cash BEGINNING 9:00 A.M. AT WWW.LEE.REALFORECLOSE.COM IN ACCORDANCE WITH CHAPTER 45 FLORIDA STATUTES, January 5, 2012, the following described property as set forth in said Final Judgment, to-wit:
LOTS 8 AND 9, BLOCK 15, UNIT 3, SECTION 20, TOWNSHIP 44 SOUTH, RANGE 25 EAST LEHIGH ACRES, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 26 PAGE 30 OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
