NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment of Foreclosure filed May 14, 2010 and an Order Rescheduling Foreclosure Sale filed December 8, 2011 entered in Civil Case No.: 10-CA-50526 (H) of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK AS TRUSTEE FOR THE CERTIFICATEHOLDERS CWABS INC. ASSET-BACKED CERTIFICATES SERIES 2005-12, Plaintiff, and RICHARD N. PATRICK, CYNTHIA PATRICK, UNKNOWN TENANT(S) IN POSSESSION #1 N/K/A MARY REETZ are Defendants.
I will sell to the highest bidder for cash, www.lee.realforeclose.com, at 9:00 AM, on the 23 day of March, 2012, the following described real property as set forth in said Final Summary Judgment, to wit:
LOT 18 AND THE NORTH 1/2 OF LOT 17, UNIT B, BAYSHORE GARDENS, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 12, PAGE 130, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
