Notice is hereby given pursuant to the final judgment/order entered in the above noted case, that I will sell the following property situated in Manatee County, Florida, described as:
Unit #18-4, Paradise Bay Estates, a Residential Cooperative, according to Exhibit “B” (Plat Plan) of the Master Form Proprietary Lease recorded in Official Records Book 1446, Pages 7204 through 7262, together with Scrivener's Affidavit recorded in Official Records Book 1450, Page 3494, and the Public Records of Manatee County, Florida.

This property is in reference to the following mobile home and contents:

1956 MAGN House Trailer, VIN #56352900, TITLE #8603542, located at: 10315 Cortez Road W., #18-4, Bradenton, FL 34210
At public sale, to the highest and best bidder for cash, online via the internet at www.manatee.realforeclose.com, at 11:00 a.m. on December 28, 2011.
REGISTER WITH CLERK: On the day of the sale, prior to the sale, you shall report to the Clerk's Office, identify yourself to the Clerk who will be conducting the sale and disclose to that Clerk your good faith deposit. Plaintiff is not required to make the good faith deposit, as Plaintiff has a credit of the Judgment amount.
GOOD FAITH DEPOSIT: All bidders other than Plaintiff (person holding the Judgment) must be prepared to tender to the Clerk in cash or cashier's check a good faith deposit of 5% of the final bid. The amount of deposit required is pursuant to Florida Statute 45.031(2).
DEPOSIT REQUIRED: At the time of the sale, the successful high bidder shall post with the clerk a deposit equal to 5% of the final bid. The deposit shall be applied to the sale price at the time of payment. If final payment is not made within the prescribed period, the clerk shall re-advertise the sale as provided in this section and pay all costs of the sale from the deposit. Any remaining funds shall be applied toward the judgment.
REGISTRY OF THE COURT SERVICE CHARGE: Effective November 1, 2005, the Clerk will charge a registry of the court service charge on all Foreclosure deposits made in connection with a judicial sale. Pursuant to Florida Statute 28.24(10), the fee assessed will be 3% of the first $500.00 and 1.5% for everything over $500.00. This fee will be assessed on the full bid amount and must be paid at the time of the transaction.
THE SALE. If the property is sold to someone other than the Plaintiff, that bidder will be required produce the good faith deposit prior to the Clerk announcing him/her as successful buyer. The Clerk will close the sale once the deposit is verified. After the good faith deposit has been tendered by the high bidder, that bidder will be instructed to return to the Clerk's Office no later than 4:00 p.m. that same day with the balance of the bid in the form of cash or cashier's check payable only to the Clerk. If bidder does not return within this prescribed period, the good faith deposit will be forfeited pursuant to Florida Statute 45.031(2).
If the high bidder does not tender the good faith deposit as required, the Clerk will make such an announcement and resume the sale with the last highest bid and continue until the highest bid and the good faith deposit is verified. Once a high bid is accepted, the same procedure will follow. The good faith deposit must be in the form of cash or a cashier's check payable to “R. B. Shore, Clerk of the Circuit Court, or (bidder name).” Both names must be included. The Clerk will not accept any other form of payment. If the Final Judgment states otherwise regarding the good faith deposit, the Clerk will follow the Judge's Order.
FINAL PAYMENT: Purchase Price Must Be Paid in Full by Cash or Cashier's Check no later than 4:00 p.m. on Day of Sale. At the time of final payment, the successful high bidder shall leave with the Clerk the complete name(s), phone number and mailing address to which the Certificate of Title should be issued. It is important to notify the Clerk then as to how Title will be issued because changes after the Certificate of Sale is issued are not possible without an assignment of Bid. The high bidder will also be notified of any documentary stamps to be affixed to the Title; the Judgment may indicate who is obligated to pay the stamps. This money must also be received by the Clerk on the date Title is to be issued.
