NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Mortgage Foreclosure dated November 28, 2011and entered in Case No. 41-2010-CA-004601 of the Circuit Court of the TWELFTH Judicial Circuit in and for MANATEE County, Florida wherein THE BANK OF NEW YORK MELLON, FKA THE BANK OF NEW YORK AS TRUSTEE FOR BEAR STEARNS ASSET BACKED SECURITIES TRUST 2006-SD4, ASSET-BACKED CERTIFICATES, SERIES 2006-SD4 is the Plaintiff and MARIO L MARQUEZ A/K/A MARIO MARQUEZ; THE PALMS OF CORTEZ CONDOMINIUM ASSOCIATION, INC.; TENANT #1 N/K/A MICHELE DESILATS, and TENANT #2 N/K/A DAVE DESILATS are the Defendants, The Clerk will sell to the highest and best bidder for cash at on the Internet at: www.manatee.realforeclose.com at 11:00AM, on the 5th day of January , 2012 the following described property as set forth in said Final Judgment:
BUILDING NO. 10, UNIT NO.13, THE PALMS OF CORTEZ, A CONDOMINIUM ACCORDING TO THE DECLARATION OF CONDOMINIUM RECORDED JULY 14, 2005 IN OFFICIAL RECORDS BOOK 2038, PAGES 5178 THROUGH 5309, AS AMENDED IN OFFICIAL RECORDS BOOK 2041, PAGE 6955, TOGETHER WITH ALL OTHER EXHIBITS AND AMENDMENTS THERETO, OF THE PUBLIC RECORDS OF MANATEE COUNTY, FLORIDA. TOGETHER WITH THE EXCLUSIVE RIGHT TO USE GARAGE SPACE NO. G40, SAID SPACE HAVING BEEN ASSIGNED TO GRANTEE ON THIS DATE AND BEING HEREBY DECLARED TO BE A LIMITED COMMON ELEMENT AND APPURTENANT TO THE ABOVE DESCRIBED UNIT WHICH SHALL HEREINAFTER PASS AS AN APPURTENANCE THERETO WITHOUT FURTHER ASSIGNMENT IN ACCORDANCE WITH ARTICLE III, SUBPARAGRAPH I OF THE DECLARATION OF CONDOMINIUM.
