NOTICE IS HEREBY GIVEN that pursuant to a Final Judgment of Foreclosure entered on the 30 day of November, 2011, in that certain cause pending in the Circuit Court in and for Manatee County, Florida, wherein BMO HARRIS BANK, N.A., successor by merger to THE HARRIS BANK, N.A., is the Plaintiff and CHRISTINE T. ELY, WILLIAM H. ELY, JANE DOE and JOHN DOE, are the Defendants, Civil Action Case No. 2011 CA 002828, R.B. “Chips” Shore, Clerk of the aforesaid Court, will at 11:00 a.m. on January 3, 2012, offer for sale and sell to the highest bidder for cash via the internet at www.manatee.realforeclose.com, the following described property, situate and being in Manatee County, Florida, to wit:
Begin at the Southeasterly corner of Lot 9, Block 78, Country Club Addition to Whitfield Estates, Section B, as recorded in Plat Book 8, Page 1 of the Public Records of Manatee County, Florida; thence N 66 degree 03' 00” W along the Southwesterly line of said Lot 9, 140.00 feet to the intersection of said line and the new Easterly R/W of Magellan Drive (DeSoto Drive), said point also being on the ARC of a curve, whose radius point lies S 78 degree 12' 21” E 452.5 feet; thence Northeasterly along said R/W and the Arc of said curve through a central angle of 14 degree 01' 12”, 110.45 feet to the intersection of said ARC and the Northwesterly line of said Lot 9, said point lying S 24 degree 00' 00” W, 10.0 feet from the Northwesterly corner of said Lot 9; thence S 66 03' 00” E, parallel to the Northeasterly line of said Lot 9 and 10.00 feet therefrom, 150.00 feet to the intersection of said line and the Southeasterly line of said Lot 9; thence S 24 degree 00' 00” W, along said Southeasterly line, 110.00 feet to the POB, being a portion of Lot 9, Block 78, of said Country Club addition to Whitfield Estates, Section B.
Said sale will be made pursuant to and in order to satisfy the terms of said Final Judgment of Foreclosure.
IF YOU ARE A SUBORDINATE LIENHOLDER CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS.
