NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale dated the 13th day of December, 2011, and entered in Case No. 2008 CA 010174, of the Circuit Court of the 12TH Judicial Circuit in and for Manatee County, Florida, wherein BANK OF AMERICA, N.A. AS SUCCESSOR BY MERGER TO BAC HOME LOANS SERVICING, LP FKA COUNTRYWIDE HOME LOANS SERVICING, LP is the Plaintiff and UNKNOWN HEIRS, BENEFICIARIES, DEVISEES, ASSIGNEES, LIENORS, CREDITORS, TRUSTEES AND ALL OTHERS WHO MAY CLAIM AN INTEREST IN THE ESTATE OF ESTELLE J. ROTH, DECEASED, THE FOURTH BAYSHORE CONDOMINIUM ASSOCIATION, INC., UNKNOWN SPOUSE OF ESTELLE J ROTH and JOHN DOE, JANE DOE AS UNKNOWN TENANT (S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.manatee.realforeclose.com in accordance with Chapter 45 at, 11:00 AM on the 20th day of January, 2012, the following described property as set forth in said Final Judgment, to wit:
UNIT K-28, BUILDING “K” THE FOURTH BAYSHORE CONDOMINIUM, A CONDOMINIUM ACCORDING TO THE DECLARATION OF CONDOMINIUM AS RESTATED AND AMENDED IN OFFICIAL RECORDS BOOK 1508, PAGE 6261 AND IN OFFICIAL RECORDS BOOK 1577, PAGE 714 AND AMENDMENTS THERETO, AND AS PER PLAT THEREOF, RECORDED IN CONDOMINIUM PLAT BOOK 17, PAGE 117, AND AMENDMENTS THERETO, OF THE PUBLIC RECORDS OF MANATEE COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
