NOTICE IS HEREBY GIVEN pursuant to an Order Rescheduling Foreclosure Sale filed December 9, 2011, and entered in Case No. 2009 CA 012908 NC, of the Circuit Court of the 12th Judicial Circuit in and for SARASOTA County, Florida. THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK AS SUCCESSOR IN INTEREST TO JPMORGAN CHASE BANK, N. A. AS TRUSTEE FOR THE STRUCTURED ASSET MORTGAGE INVESTMENTS II INC. BEAR STEARNS ALT-A TRUST, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2005-5 is Plaintiff and GREGGERY P. ZARRIS A/K/A GREP P. ZARRIS; CYNTHIA S. ZARRIS; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES OR OTHER CLAIMANTS; JOHN DOE AND; JANE DOE AS UNKNOWN TENANTS IN POSSESSION; UNKNOWN PERSONS IN POSSESSION OF THE SUBJECT PROPERTY; MORTGAGE ELECTRONIC REGISTATION SYSTEMS, INC.; are defendants. The Clerk of Court will sell to the highest and best bidder for cash by electronic sale at: www.sarasota.realforeclose.com, at 9:00 a.m., on the 13 day of January, 2012, the following described property as set forth in said Final Judgment, to wit:
LOT 4, LAKE RITTWOOD SUBDIVISION, AS PER PLAT THEREOF RECORDED IN PLAT BOOK 21, PAGE(S) 30, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA
A person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim with 60 days after the sale.
