NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure dated the 19th day of September, 2011, and entered in Case No. 2009 CA 005448 NC, of the Circuit Court of the 12TH Judicial Circuit in and for Sarasota County, Florida, wherein BAC HOME LOANS SERVICING, LP is the Plaintiff and PETER F. KLEIN, BANK OF AMERICA, N.A., HARBOR TOWERS OWNERS ASSOCIATION, INC., PALLAS ELKHEART A/K/A PALLAS E. ELKHEART and UNKNOWN TENANT (S) IN POSSESSION OF THE SUBJECT PROPERTY IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.sarasota.realforeclose.com at, 9:00 AM on the 17th day of January, 2012, the following described property as set forth in said Final Judgment, to wit:
UNIT NO. 411, HARBOR TOWERS YACHT AND RACQUET CLUB, A CONDOMINIUM ACCORDING TO THE DECLARATION OF CONDOMINIUM RECORDED IN OFFICIAL RECORDS BOOK 1115 PAGE 1346, AND AMENDMENTS THERETO AND AS PER PLAT THEREOF RECORDED IN CONDOMINIUM BOOK 9, PAGES 16, 16A THRU 16D, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA, TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPURTENANT THERETO.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
