NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure filed the 17 day of June, 2011, and entered in Case No. 36-2010-CA-054074, of the Circuit Court of the 20TH Judicial Circuit in and for Lee County, Florida, wherein the bank of new york mellon f/k/a the bank of new york, as trustee for the holders of the certificates, first horizon home mortgage pass-through certificates series fhams 2006-fa1, by first horizon home loans, a division of first tennessee bank national association, master servicer, in its capacity as agent for the trustee under the pooling and servicing agreement is the Plaintiff and daniel anderson, lenders investment corp., a dissolved corporation, katherine anderson and unknown tenant (S) in possession of the subject property are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.Lee.realforeclose.com at, 9:00 AM on the 18 day of July, 2011, the following described property as set forth in said Final Judgment, to wit:
lots 38 and 39, block 1354, unit 18, cape coral subdivision, according to the plat thereof, recorded in plat book 13, pages 96 through 120, inclusive, in the public records of lee county, Florida.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
