NOTICE IS HEREBY GIVEN pursuant to an Order of Final Judgment of Foreclosure filed June 30, 2011, entered in Civil Case No. 2009-CA-068758 of the Circuit Court of the 20th Judicial Circuit in and for Lee County, Florida, wherein Deutsche Bank National Trust Company, as Trustee for IXIS Real Estate Capital Trust 2006-HE1, Plaintiff and Michael A. Gilarski a/k/a Michael A. Gilarski, II are defendant(s), I will sell to the highest and best bidder for cash BEGINNING 9:00 A.M. AT WWW.LEE.REALFORECLOSE.COM IN ACCORDANCE WITH CHAPTER 45 FLORIDA STATUTES on October 28, 2011, the following described property as set forth in said Final Judgment, to-wit:
A PARCEL OF LAND IN GOVERNMENT LOT 1 OF SECTION 34, TOWNSHIP 46 SOUTH, RANGE 24 EAST, DESCRIBED AS FOLLOWS: COMMENCING AT THE SOUTHEASTERLY CORNER OF BLOCK “I” IN MCPHIE PARK SUBDIVISION, UNIT NO. 2, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 8, PAGE 59, PUBLIC RECORDS OF LEE COUNTY, FLORIDA; THENCE RUN SOUTHWESTERLY ALONG A LINE WHICH IS AN EXTENSION OF THE SOUTHEASTERLY LINE OF SAID BLOCK “I” TO THE WATERS OF THE GULF OF MEXICO; THENCE SOUTHEASTERLY ALONG THE WATERS OF SAID GULF TO A POINT 590 FEET, AS MEASURED AT RIGHT ANGLES TO THE LAST MENTIONED COURSE; THENCE NORTHEASTERLY ON A LINE PARALLEL TO THE SOUTHEASTERLY LINE OF THE AFOREMENTIONED BLOCK “I” TO THE EASTERLY SIDE OF THE COUNTY ROAD, THE POINT ON THE SAID COUNTY ROAD ON THE EASTERLY SIDE THEREOF, BEING IN ACCORDANCE WITH THAT CERTAIN DEED FROM LEONARD SANTINI AND WIFE TO LEE COUNTY, FLORIDA, RECORDED IN DEED BOOK 193, PAGE 583, OF SAID PUBLIC RECORDS; THENCE SOUTHEASTERLY ALONG THE EASTERLY SIDE OF SAID COUNTY ROAD A DISTANCE OF 50.52 FEET; THENCE NORTHEASTERLY ON A LINE PARALLEL TO THE SOUTHEASTERLY LINE OF THE AFOREMENTIONED BLOCK “I” A DISTANCE OF 436.19 FEET TO THE POINT OF BEGINNING OF THE LAND HEREIN DESCRIBED; THENCE RETURNING SOUTHWESTERLY ON A LINE PARALLEL TO THE SOUTHEASTERLY LINE OF THE AFOREMENTIONED BLOCK “I” A DISTANCE OF 60 FEET; THENCE SOUTHEASTERLY AT RIGHT ANGLES TO THE LAST MENTIONED COURSE A DISTANCE OF 120 FEET TO THE WATERS OF A CANAL; THENCE NORTHEASTERLY ALONG THE WATERS OF SAID CANAL AND AT RIGHT ANGLES TO THE LAST MENTIONED COURSE A DISTANCE OF 60 FEET; THENCE NORTHEASTERLY AT RIGHT ANGLES TO THE LAST MENTIONED COURSE A DISTANCE OF 120 FEET TO THE POINT OF BEGINNING (KNOWN AS LOT 10, BLOCK “A” OF SANTINI CROSS UNRECORDED PLAT).
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
