NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale Date dated the 28th day of June, 2011, and entered in Case No. 2009 CA 012072, of the Circuit Court of the 12TH Judicial Circuit in and for Manatee County, Florida, wherein THE BANK OF NEW YORK,AS TRUSTEE, ON BEHALF OF THE CERTIFICATEHOLDERS OF CWALT, INC.,ALTERNATIVE LOAN TRUST 2004-36CB MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2004-36CB is the Plaintiff and LORI M. MADDEN; LONGBOAT HARBOUR OWNERS ASSOCIATION, INC.; WINDWARD BAY, INC. F/K/A LONGBOAT HARBOUR NORTH CONDOMININIUN, INC.; SEAN C. MADDEN A/K/A SEAN MADDEN; UNKNOWN TENANT (S); JOHN DOE; JANE DOE AS UNKNOWN TENANT (S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell the property to the highest and best bidder for cash electronically at www.manatee.realforeclose.com in accordance with Chapter 45 at, 11:00 AM on the 2nd day of August, 2011, the following described property as set forth in said Final Judgment, to wit:
UNIT 1-V-11-C, BUILDING K, WINDWARD BAY F/K/A LONGBOAT HARBOUR NORTH, A CONDOMINIUM ACCORDING TO THE DECLARATION OF CONDOMINIUM RECORDED IN OFFICIAL RECORDS BOOK 596, PAGE 819, AS AMENDED, AND AS PER PLAT THEREOF RECORDED IN CONDOMINIUM BOOK 3, PAGES 82 THROUGH 85, AND AMENDED IN CONDOMINIUM BOOK 6, PAGE 6, PUBLIC RECORDS OF MANATEE COUNTY, FLORIDA. TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPURTENANT THERETO.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
