NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment of Foreclosure dated June 30, 2011, entered in Civil Case No.: 29-2009-CA-001858 (H) of the Circuit Court of the Thirteenth Judicial Circuit in and for Hillsborough County, Florida, wherein THE BANK OF NEW YORK MELLON, AS SUCCESSOR TRUSTEE UNDER NOVASTAR MORTGAGE FUNDING TRUST, SERIES 2006-3, Plaintiff, and TENNELE G. GONZALEZ, ALEJANDRO GONZALEZ A/K/A ALEJANDRO R. GONZALEZ, JAMES BALL, STATE OF FLORIDA DEPARTMENT OF REVENUE, HILLSBOROUGH COUNTY, TRACY SAUNDERS PAINTING, INC., are Defendants.
I will sell to the highest bidder for cash, on the 2nd floor, rooms 201/202 in the George E. Edgecomb Courthouse, 800 E. Twiggs Street, Tampa, FL 33602 at 10 AM, on the 4 day of August, 2011, the following described real property as set forth in said Final Summary Judgment, to wit:

Part of the SE 1/4 of NW 1/4 of Section 31, Township 31 South, Range 21 East, Hillsborough County, Florida, and being more particularly described as follows:
For a point of reference commence at the NE corner of said SE 1/4 of NW 1/4 and run thence North 89 degrees, 16 minutes, 19 seconds West, along North Boundary thereof a distance of 506.29 feet; thence South 00 degrees, 43 minutes, 41 seconds West, a distance of 42.47 feet to a point 25 feet South of the centerline of paving of Sweat Loop Road (as now laid out and existing) for the Point of Beginning of the Tract herein described; thence South 88 degrees, 45 minutes, 34 seconds East along a line 25 feet South of and parallel to the aforesaid centerline of paving of Sweat Loop Road a distance of 491.45 feet to a point on the Westerly right of way line of Carlton Lake Road; thence South 00 degrees, 07 minutes, 56 seconds West along said Westerly right of way line a distance of 383.83 feet; thence North 88 degrees, 45 minutes, 34 seconds West a distance of 643.63 feet; thence North 21 degrees, 54 minutes, 26 seconds East a distance of 410.15 feet to the Point of Beginning.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
