NOTICE IS HEREBY GIVEN pursuant to an Order Rescheduling Foreclosure Sale filed July 7th, 2011, and entered in Case No. 41 2009 CA 002760, of the Circuit Court of the 12th Judicial Circuit in and for MANATEE County, Florida. DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE OF THE INDYMAC INDX MORTGAGE LOAN TRUST 2005-AR33, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2005-AR33 UNDER THE POOLING AND SERVICING AGREEMENT DATED DECEMBER 1, 2005 is Plaintiff and LAURIE A. SAMUELS; THE UNKNOWN SPOUSE OF LAURIE A. SAMUELS; WILLIAMS F. SAMUELS, JR. A/K/A WILLIAM SAMUELS, JR.; THE UNKNOWN SPOUSE OF WILLIAM F. SAMUELS, JR. A/K/A WILLIAM SAMUELS, JR. ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER, AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT (S) WHO ARE NOT KNOWN TO BE DEAD OR ALIV, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS; TENANT #1; TENANT #2; TENANT #3; TENANT #4 the names being fictitious to account for parties in possession; CITIBANK, NATIONAL ASSOCIATION SUCCESSOR BY MERGER TO CITIBANK, FEDERAL SAVINGS BANK; are defendants. The Clerk of Court will sell to the highest and best bidder for cash by electronic sale at: www.manatee.realforeclose.com, at 11:00 a.m., on the 11th day of August, 2011, the following described property as set forth in said Final Judgment, to wit:
LOT 823, OF RIVERDALE REVISED, A SUBDIVISION AS PER PLAT THEREOF, RECORDED IN PLAT BOOK 10, PAGE 40, OF THE PUBLIC RECORDS OF MANATEE COUNTY, FLORIDA.
TOGETHER WITH THE FOLLOWING DESCRIBED PARCEL OF LAND:
BEGIN AT THE SOUTEAST CORNER OF SAID LOT 823, THENCE SOUTH 00 DEG. 39' 17” WEST, ALONG THE SOUTHERLY EXTENSION OF THE EAST LINE OF SAID LOT 823, A DISTANCE OF 20.00 FEET; THENCE NORTH 89 DEG 20' 43” WEST, A DISTANCE OF 75.00 FEET; THENCE NORTH 00 DEG 39' 17” EAST, A DISTANCE OF 20 FEET TO THE SOUTHWEST CORNER OF SAID LOT 823; THENCE SOUTH 89 DEG 20' 43” EAST, ALONG THE SOUTH LINE OF SAID LOT 823, A DISTANCE OF 75.00 FEET TO THE POINT OF BEGINNING.
A person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim with 60 days after the sale.
