NOTICE IS HEREBY GIVEN pursuant to an Amended Final Judgment filed July 18, 2011, entered in Case No. 11-CA-51090 of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein ervin a. simandl, trustee of the ervin a. simandl revocable living trust agreement u/t/a dated January 10, 1995 is the Plaintiff and FLORIDA AUCTION SERVICES, INC., BRIAN HENRY and ELAINE HENRY are Defendants, I will sell to the highest and best bidder for cash, beginning at 9:00 A.M. at www.lee.realforeclose.com in accordance with Chapter 45, Florida Statutes, on Wednesday, the 17th day of August, 2011, the following described property, as set forth in said Amended Final Judgment, to-wit:
The East One-half of the Northeast Quarter of the Southeast Quarter of the Southeast Quarter of Section 3, Township 44 South, Range 24 East, Lee County, Florida, less that portion lying West of State Road 45 (U.S. No. 41).

Also less and except all that portion lying within State Road 45 (U.S. No. 41) and that portion of the roadway lying on the East boundary of subject property.
Any persons claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens, must file a claim within 60 days after the sale.
