Notice is hereby given that, pursuant to a Final Judgment of Foreclosure or Order filed June 1, 2011, entered in Civil Case Number 2010-CA-053636, in the Circuit Court for Lee County, Florida, wherein the bank of new york
mellon f/k/a the bank of new york, as trustee for cwmbs, inc. chl mortgage pass-through trust 2007-hy7 mortgage pass-through certificates, series 2007-hy7 is the Plaintiff, and david barr, et al., are the Defendants, I will sell the property situated in Lee County, Florida, described as:
lots 3 and 4, block 73, unit 6, part 3, cape coral subdivision, according to the plat thereof recorded in plat book 11, pages 70 through 79, inclusive, together with the parcel described in o.r. rook 2865, page 601, more particularly described as: by extending the lot line between lots 2 and 3, a distance of 42.03 feet in the easterly direction and by extending the lot line between lots 4 and 5, a distance of 25.95 feet in the easterly direction, the area enclosed between the back lot lone of lots 3 and 4 and the two extensions previously described connected by the waterface of the constructed seawall amounting to the 2,683 square feet, more or less, all in block 73, unit 6, part 3, cape coral subdivision, according to the plat thereof recorded in plat book 11, page 70 through 79, inclusive, public records of lee county, florida
at public sale, to the highest and best bidder, for cash, at www.lee.realforeclose.com at 09:00 AM, on the 1 day of September, 2011. Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
