NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure filed the 7 day of June, 2011, and entered in Case No. 36-2009-CA-070799, of the Circuit Court of the 20TH Judicial Circuit in and for Lee County, Florida, wherein SUNTRUST BANK is the Plaintiff and PAUL A. SCHMITZ, CAPTIVA VILLAS CONDOMINIUM ASSOCIATION INC., TED KUTTRUS, DAVID M. STONE and UNKNOWN TENANT (S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.Lee.realforeclose.com at, 9:00 AM on the 8 day of August, 2011, the following described property as set forth in said Final Judgment, to wit:
UNIT R-405 OF CAPTIVA VILLAS, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF AS RECORDED IN INSTRUMENT NO. 2006000478367 OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA AND ANY AND ALL AMENDMENTS THERETO TOGETHER WITH AN UNDIVIDED INTEREST OR SHARE IN THE COMMON ELEMENTS APPURTENANT THERETO
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
