NOTICE IS HEREBY GIVEN pursuant to an Order rescheduling foreclosure sale dated June 9, 2011 entered in Civil Case No. 2009-CA-006804 of the Circuit Court of the 12th Judicial Circuit in and for Manatee County, Florida, wherein The Bank of New York Mellon f/k/a The Bank of New York, as Trustee on behalf of CIT Mortgage Loan Trust, 2007-1, Plaintiff and Dennis E. Rudd and Christina W. Rudd a/k/a Christina Rudd, Husband and Wife are defendant(s), I will sell to the highest and best bidder for cash VIA THE INTERNET AT WWW.MANATEE.REALFORECLOSE.COM, AT 11:00 A.M., on July 13,2011, the following described property as set forth in said Final Judgment, to-wit:
COMMENCE AT THE SOUTHEAST CORNER OF THE NORTHWEST 1/4 OF THE SOUTHWEST 1/4 OF SECTION 13, TOWNSHIP 35 SOUTH, RANGE 17 EAST; THENCE NORTH ALONG THE CENTERLINE OF 5TH STREET EAST, 645.10 FEET; THENCE WEST 33 FEET FOR THE POINT OF BEGINNING; THENCE SOUTH 120.05 FEET; THENCE WEST 125 FEET; THENCE NORTH 120.05 FEET; THENCE EAST 125 FEET TO THE POINT OF BEGINNING, LYING AND BEING IN SECTION 13, TOWNSHIP 35 SOUTH, RANGE 17 EAST, OF MANATEE COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
