NOTICE IS GIVEN that pursuant to the Summary Final Judgment of Foreclosure entered on the 19th day of October, 2011, in Civil Action No. 11-1445-CA, of the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida, in which CAROLINA OFFICES, INC., et al., are the Defendants, and Iberiabank, as successor in interest to Orion Bank, is the Plaintiff, I will sell to the highest and best bidder for cash on November 21, 2011, at 11:00 a.m., at the 1st Floor Atrium, Collier County Courthouse ,3315 Tamiami Trail East, Naples, Florida 34112, in accordance with Section 45.031, Florida Statutes, the following described real property as set forth in the Summary Final Judgment of Foreclosure in Collier County, Florida:
That portion of the South 1/2 of the Southwest 1/4 of the Southeast 1/4 of Section 34, Township 48 South, Range 26 East, Collier County, Florida, less and except Vanderbilt Beach Road right-of-way, being more particularly described as follows:
Commence at the Southeast corner of Section 34, Township 48 South, Range 26 East, Collier County, Florida; thence run North 89Ëš46'10” West, along the South line of the Southeast 1/4 of said Section 34, for a distance of 1,322.24 feet to the Southeast corner of the South 1/2 of the Southwest 1/4 of the Southeast 1/4 of said Section 34; thence run North 02°14'20” West, along the East Line of the Southwest 1/4 of the Southeast 1/4 of said Section 34, a distance of 145.13 feet to a point on the North right-of-way line of Vanderbilt Beach Road, a 175 foot wide right-of-way, and the Point of Beginning of the parcel of land herein described; thence continue North 02°14'20” West, along the East line of the Southwest 1/4 of the Southeast 1/4 of said Section 34, for a distance of 523.93 feet to the Northeast corner of the South 1/2 of the Southwest 1/4 of the Southeast 1/4 of said Section 34; thence run North 89Ëš47'36” West, along the North line of the South 1/2 of the Southwest 1/4 of the Southeast 1/4 of said Section 34, for a distance of 1,322.04 feet to the Northwest corner of the South 1/2 of the Southwest 1/4 of the Southeast 1/4 of said Section 34; thence run South 02Ëš13'26” East, along the West line of the Southwest 1/4 of the Southeast 1/4 of said Section 34, for a distance of 523.38 feet to a point on the North right-of-way line of said Vanderbilt Beach Road; thence run South 89Ëš46'10” East, along the North right-of-way line of said Vanderbilt Beach Road, for a distance of 1,322.20 feet to the Point of Beginning;
LESS AND EXCEPT that portion conveyed by deed recorded in Official Records Book 3573, Page 780, Public Records of Collier County, Florida;
LESS AND EXCEPT that portion conveyed by deed recorded in Official Records Book 4051, Page 359, Public Records of Collier County, Florida.
NOW KNOWN AS:
CAROLINA COMMONS LAND CONDOMINIUM, a Condominium, according to The Declaration of Condominium recorded in O.R. Book 4246, Page 3729, and all exhibits and amendments thereof, Public Records of Collier County, Florida;
LESS AND EXCEPT Unit Nos. 1 and 4 of CAROLINA COMMONS LAND CONDOMINIUM, a Condominium, according to The Declaration of Condominium recorded in O.R. Book 4246, Page 3729, and all exhibits and amendments thereof, Public Records of Collier County, Florida;
LESS AND EXCEPT Tract 3, CAROLINA COMMONS, according to the map or plat thereof as recorded in Plat Book 48, Page 78, Public Records of Collier County, Florida;
LESS AND EXCEPT all that portion of Tract A of Carolina Commons, according to the plat thereof lying within the boundaries of the following property legally described in that Special Warranty Deed recorded in Official Records Book 4100, Page 1693, of the Public Records of Collier County, Florida;
LESS AND EXCEPT Tract A-1, CAROLINA COMMONS, according to the map or plat thereof as recorded in Plat Book 48, Page 78, Public Records of Collier County, Florida.
Any person claiming an interest in the funds remaining after the sale, if any, must file a claim with the clerk No later than 60 days after this sale. if you fail to file a claim, you will not be entitled to any remaining funds.
