NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale filed the 2 day of November, 2011, and entered in Case No. 09-CA-60770, of the Circuit Court of the 20TH Judicial Circuit in and for Lee County, Florida, wherein FIRST HORIZON HOME LOANS, A DIVISION OF FIRST TENNESSEE BANK NATIONAL ASSOCIATION. is the Plaintiff and WILLIAM BOOTH, PAUL HOMES, INC., SOUTHWIND OWNERS ASSOCIATION AT FORT MYERS INC., WACHOVIA BANK NATIONAL ASSOCIATION and UNKNOWN TENANT (S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.Lee.realforeclose.com at, 9:00 AM on the 2 day of December, 2011, the following described property as set forth in said Final Judgment, to wit:
LOT 37, SOUTHWIND, A SUBDIVISION ACCORDING TO THE PLAT THEREOF, AS RECORDED IN THE OFFICE OF THE CLERK OF CIRCUIT COURT IN PLAT BOOK 66, PAGES 18 THROUGH 20 INCLUSIVE, LEE COUNTY, FLORIDA, AND ALSO ACCORDING TO THE DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR SOUTHWIND, AS RECORDED IN OFFICIAL RECORDS BOOK 3235, PAGE 1796. PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
