NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure dated the 25th day of October, 2011, and entered in Case No. 51-2009-CA-011074ES, of the Circuit Court of the 6TH Judicial Circuit in and for Pasco County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK AS SUCCESSOR TO JP MORGAN CHASE BANK, N.A.,AS TRUSTEE FOR HOLDERS OF SAMI II 2006-AR4,MTG PASS-THROUGH CERT,SERIES 2006-AR4 is the Plaintiff and DEBRA CARTER A/K/A DEBORAH L.CARTER; MIDLAND FUNDING, LLC; THE BELMONT AT RYALS CHASE CONDOMINIUM ASSOCIATION, INC; UNKNOWN TENANT (S); IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash, on the 12th day of December, 2011, at 11:00 AM on Pasco County's Public Auction website: AT WWW.PASCO.REALFORECLOSE.COM PURSUANT TO JUDGMENT OR ORDER OF THE COURT AND CHAPTER 45, FLORIDA STATUTES. in accordance with chapter 45, the following described property as set forth in said Final Judgment, to wit:
THAT CERTAIN CONDOMINIUM PARCEL COMPOSED OF UNIT NO. 8-201, OF THE BELMONT AT RYALS CHASE, A CONDOMINIUM AND AN UNDIVIDED INTEREST OR SHARE IN THE COMMON ELEMENTS APPURTENANT THERETO, IN ACCORDANCE WITH, AND SUBJECT TO THE COVENANTS, CONDITIONS, RESTRICTIONS, EASEMENTS, TERMS AND OTHER PROVISIONS OF THE DECLARATION OF CONDOMINIUM, AS RECORDED IN O.R. 6561, PAGE 416, AND ANY AMENDMENTS THERETO, AND THE PLAT THEREOF, AS RECORDED IN CONDOMINIUM PLAT BOOK, PUBLIC RECORDS OF PASCO COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
