NOTICE IS HEREBY GIVEN pursuant to an Order Restting Foreclosure Sale dated the 9th day of September, 2011, and entered in Case No. 08-18012, of the Circuit Court of the 6TH Judicial Circuit in and for Pinellas County, Florida, wherein u.s. bank nationAL ASSOCIATION, AS TRUSTEE FOR J.P. MORGAN MORTGAGE ACQUISITION TRUST 2006-WMC3, ASSET BACKED PASS-THROUGH CERTIFICATES, SERIES
2006-WMC3, is the Plaintiff and THOMAS A. PHELAN; INVERNESS CONDOMINIUM I ASSOCIATION, INC.; MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS NOMINEE FOR WMC MORTGAGE CORP.; STATE OF FLORIDA DEPARTMENT OF REVENUE; UNITED STATES OF AMERICA DEPARTMENT OF THE TREASURY; AMY C. PHELAN; UNKNOWN SPOUSE OF THOMAS A. PHELAN; UNKNOWN TENANT (S); IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash, on the 27th day of October, 2011, at 10:00 AM on Pinellas Countys Public Auction website: www.pinellas.realforeclose.com in accordance with chapter 45, the following described property as set forth in said Final Judgment, to wit:
THAT CERTAIN CONDOMINIUM PARCEL COMPOSED OF UNIT 1306, BUILDING 1, AND AN UNDIVIDED INTEREST OR SHARE IN THE COMMON ELEMENTS APPURTENANT THERETO, IN ACCORDANCE WITH, AND SUBJECT TO THE COVENANTS, CONDITIONS, RESTRICTIONS, EASEMENTS, TERMS AND OTHER PROVISIONS OF THE DECLARATION OF CONDOMINIUM OF INVERNESS CONDOMINIUM I, PHASE I, A CONDOMINIUM, RECORDED IN OFFICIAL RECORDS BOOK 5046, PAGES 1254 THROUGH 1346, INCLUSIVE, TOGETHER WITH ANY ADDITIONS AND AMENDMENTS THERETO AND THE PLAT THEREOF AS RECORDED IN CONDOMINIUM PLAT BOOK 43, PAGES 1 THROUGH 6 AND AMENDED IN CONDOMINIUM PLAT BOOK 47, PAGES 68 THROUGH 75, INCLUSIVE, OF THE PUBLIC RECORDS OF PINELLAS COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
