TO CLOSE ESTATE

Petitioner, vs
BRIAN R. SKELLY, CHERISE L. SKELLY, SHERYL E. SANDERS and FRANK HUGULEY,
Respondents.
COMES NOW, ROBERT J. JONES, Esquire, Personal Representative of the referenced Estate, and he responds to the Court's Order to File Documents Required to Close Estate entered on September 22, 2011, and he would show that there are good grounds to continue to administer this Estate for the following reasons:
1. An adversary complaint was filed in the case to partition real property of the Estate and the Court granted partial relief for the same on July 26, 2011 (Order on Motion for Writ of Possession) and June 20, 2011 (Order to Partition Real Property).
2. The Orders are been carried out, presently, and the proceeds from the prospective sale of the real property will be used to satisfy the claims of creditors.
3. But before there are proceeds, the property must be sold into the private and/or public real estate market.
4. The real estate market into which the property will be sold is non-functional and has been, since the opening of this Estate.
5. The property is presently listed for sale with a realtor, as the undersigned informed the Court was its intent, following which, if not successful, the property will be auctioned.
A. In so doing the interests of all interested parties and of the creditors of the Estate will be optimized.
WHEREFORE, the undersigned Personal Representative requests that the Court: (A.) set aside its Order to File Required Documents; (B.) grant the undersigned an enlargement of time of six (6) months to file the same until after the sale of the real property in the Estate; and (C.) grant the undersigned such other and further relief as the Court deems necessary to achieve proper administration of this case.
