NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale filed the 28 day of September, 2011, and entered in Case No. 36-2009-CA-068809, of the Circuit Court of the 20TH Judicial Circuit in and for Lee County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK, AS TRUSTEE FOR THE CERTIFICATEHOLDERS CWALT, INC., ALTERNATIVE LOAN TRUST 2006-OA21, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2006- OA21 is the Plaintiff and MARY E. KELLY; MYERLEE GARDENS CONDOMINIUM ASSOCIATION, INC; UNKNOWN SPOUSE OF MARY E. KELLY and UNKNOWN TENANT (S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.Lee.realforeclose.com at, 9:00 AM on the 28 day of October, 2011, the following described property as set forth in said Final Judgment, to wit:
CONDOMINIUM PARCEL; APARTMENT NO. 17, OF MYERLEE GARDENS CONDOMINIUM, A CONDOMINIUM, ACCORDING TO THE PLAT THEREOF AND BEING FURTHER DESCRIBED IN THAT CERTAIN DECLARATION OF CONDOMINIUM RECORDED IN O.R. BOOK 1583, PAGE 620 ET SEQ., TOGETHER WITH SUCH ADDITIONS AND AMENDMENTS TO SAID DECLARATION AS FROM TIME TO TIME MAY BE MADE AND TOGETHER WITH AN UNDIVIDED INTEREST OR SHARE IN THE COMMON ELEMENTS APPURTENANT THERETO. ALL AS RECORDED IN THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
