NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure filed September 14, 2010, and entered in Case No. 09-CA-054352, of the Circuit Court of the Twentieth Judicial Circuit in and for LEE County, Florida. BANK OF AMERICA, N.A. (hereafter “Plaintiff”), is Plaintiff and GARY MUZZONIGRO; UNKNOWN SPOUSE OF GARY MUZZONIGRO IF ANY; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES OR OTHER CLAIMANTS; BILLIE POSONSKI; ROYAL GREENS AT GATEWAY CONDOMINIUM ASSOCIATION, INC; JOHN DOE AND JANE DOE AS UNKNOWN TENANTS IN POSSESSION, are defendants. I will sell to the highest and best bidder for cash via the internet at www.lee.realforeclose.com, at 9:00 a.m., on the 21 day of October, 2011, the following described property as set forth in said Final Judgment, to wit:
CONDOMINIUM UNIT NO. 1318, BUILDING 13, OF ROYAL GREENS AT GATEWAY CONDOMINIUM, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM, THEREOF, AS RECORDED UNDER CLERK'S FILE NO. 200600154122 OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA, TOGETHER WITH ALL APPURTENANCE THERETO, AND AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS OF THE SAID CONDOMINIUM.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within sixty (60) days after the sale.
