NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment filed SEPTEMBER 30, 2011, entered in Civil Case No.: 36-2011-CA-050551, DIVISION: G of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein HSBC BANK USA, N.A., AS INDENTURE TRUSTEE FOR THE REGISTERED HOLDERS OF THE RENAISSANCE HOME EQUITY LOAN ASSET-BACKED CERTIFICATES, SERIES 2005-1 is Plaintiff, and KENNETH R. HARDEN, RUTH ANN HARDEN and MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. AS NOMINEE FOR FIDELITY MORTGAGE, A DIVISION OF DELTA FUNDING CORPORATION, are Defendants.
I will sell to the highest bidder for cash at 9:00 a.m. online at www.lee.realforeclose.com on the 31 day of October, 2011 the following described real property as set forth in said Final Summary Judgment, to wit
THE FOLLOWING DESCRIBED PROPERTY IN LEE COUNTY FLORIDA, TO WIT: FROM THE S.W. CORNER OF ORIGINAL LOT 4,BLOCK 60, UNIT 6 OF FORT MYERS SHORES, A SUBDIDIVION ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 17, PAGE 75 THROUGH 79, IN THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA, SAID POINT ALSO BEING THE POINT OF BEGINNING, OF N 77 DEGREES 11 MINUTES E, 40 FEET TO A POINT ON A CURVE; THENCE ALONG SAID CURVE TO THE RIGHT, THROUGH A DELTA ANGLE OF 36 DEGREES 34 MINUTES 19 SECONDS AND HAVE A RADIUS OF 63.79 FEET FOR AN ARC DISTANCE OF 40.72; THENCE GO N 79 DEGREES 06 MINUTES 40 SECONDS W. FOR 125.50 FEET TO A POINT ON THE EASTERLY RIGHT OF WAY LINE OF CARTAGENA AVE; THENCE ALONG SAID CURVE LEFT, THROUGH A DELTA ANGLE OF 40 DEGREES 30 MINUTES 00 SECONDS AND HAVING A RADIUS OF 120.30 FOR AN ARC DISTANCE OF 85.04 FEET TO THE POINT OF BEGINNING. SAID PARCEL BEGIN ALL OF ORIGINAL LOT 4 AND PART OF LOT 5; BLOCK 60 UNIT 6 FORT MYERS SHORES.
