NOTICE IS HEREBY GIVEN that pursuant to a Uniform Final Judgment of Foreclosure dated August 31, 2011, in that certain cause pending in the Circuit Court in and for Pinellas County, Florida, wherein STEARNS BANK, N.A., as successor to First State Bank of Pinellas by asset acquisition from the FDIC as receiver for First State Bank of Pinellas is the Plaintiff, and JOSEPH STANGANELLI, GISELLA C. STANGANELLI, FLORIDA BODY SHOP AND REBUILDERS, INC., and THE UNITED STATES OF AMERICA, are Defendants, Civil Action Case No. 10-016560-CI-21, I, Ken Burke, Clerk of the aforesaid Court, will at 10:00 a.m. on November 18, 2011, offer for sale and sell to the highest bidder for cash in an on-line sale at www.pinellas.realforeclose.com, after giving notice as required by Section 45.031, Florida Statutes, the real property identified as Parcel 1 and Parcel 2 in the Judgment, situated and being in Pinellas County, Florida, and described as,
Parcel 1:
The West 100 feet of the South 200 feet of Lot 12 in SW 1/4 of Section 5, Township 30 South, Range 16 East according to the Plat of Pinellas Groves, Inc., recorded in Plat Book 1, Page 55, Public Records of Pinellas County, Florida, less that part lying within the South line of Section 5, Township 30 South, Range 16 East for road right of way.
PARCEL 2:
The South 286.77 feet of the West 200.00 feet of Lot 12, Pinellas Groves, in the Southwest 1/4 of Section 5, Township 30 South, Range 16 East, as recorded in Plat Book 1, Page 55 of the Public Records of Pinellas County, Florida.
LESS AND EXCEPT the South 200.00 feet of the West 100.00 feet thereof.
ALSO LESS AND EXCEPT that portion which falls within the existing Right of Way of Ulmerton Road (a/k/a State Road 688).
More particularly described as follows:
From the Southwest corner of Section 5, Township 30 South, Range 16 East, run South 89 degrees 51' 27” East, along the South line of Section 5, a distance of 1328.61 feet to the Southwest corner of said Lot 12, run thence North -- degrees 34' 23” West, along the West line of said Lot 12, a distance of 200.00 feet to the point of beginning; thence continue North 00 degrees 34' 23” West, a distance of 66.77 feet, thence run South 89 degrees 51' 27” East a distance of 200.00 feet, then run South 00 degrees 34' 23” East, a distance of 185.977 feet to the North Right of Way line of Sate Road 688, thence along said Right of Way line run South 89 degrees 47' 33” West, a distance of 99.99 feet, thence run North 00 degrees 34' 23” West a distance of 119.82 feet, thence run North 89 degrees 51'27” West a distance of 100.00 feet to the point of beginning.
BOTH PARCELS COLLECTIVELY DESCRIBED AS:
The South 268.77 feet of the West 200.00 feet of Lot 12, Pinellas Groves, Inc., in the Southwest 1/4 of Section 5, Township 30 South, Range 16 East, as recorded in Plat Book 1, Page 55 of the Public Records of Pinellas County, Florida, Less and Except that portion which fall within the existing right of way of Ulmerton Road (a/k/a State Road 688).
Being more particularly described as follows:
From the Southwest corner of the Southeast 1/4 of the Southwest 1/4 of said Section 5, N 00 degrees 34' 23” W, 88.00 feet to the point of beginning (P.O.B.) said point also being on the North right of way line of Ulmerton Rd., thence N 00 degrees 34' 23” W, along the West line of said Lot 12 for 187.01 feet; thence S 89 degrees 51' 27” E, 200.00 feet, thence S 00 degrees 34' 23” E 185.97 feet to a point on the aforementioned North right of way line, thence S 82 degrees 47' 33” W, along said right of way line for 199.92 feet to the point of beginning.
Said sale will be made pursuant to and in order to satisfy the terms of said Uniform Final Judgment of Foreclosure. Any person claiming an interest in the surplus from said sale, if any, other than the property owner as of the date of the lis pendens, must file a claim within 60 days after the sale.
