NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment of Foreclosure dated September 19, 2011, entered in Civil Case No.: 2009-CA-016323-NC (a) of the Circuit Court of the Twelfth Judicial Circuit in and for Sarasota County, Florida, wherein THE BANK OF NEW YORK MELLON, AS SUCCESSOR TRUSTEE UNDER NOVASTAR MORTGAGE FUNDING TRUST, SERIES 2005-4, Plaintiff, and JUDITH SCHAETZER A/K/A JUDY SCHAETZER, MICHAEL SCHAETZER, STONEYBROOK AT VENICE COMMUNITY ASSOCIATION, INC., and ALL OTHER UNKNOWN PARTIES, including, if a named Defendant is deceased, the personal representatives, the surviving spouse, heirs, devisees, grantees, creditors, and all other parties claiming, by, through, under or against that Defendant, and all claimants, persons or parties, natural or corporate, or whose exact legal status is unknown, claiming under any of the above named or described Defendants.
KAREN E. RUSHING, The Clerk of the Circuit Court, will sell to the highest bidder for cash, www.sarasota.realforeclose.com at 09:00 AM, on the 24th day of OCTOBER, 2011, the following described real property as set forth in said Final Summary Judgment, to wit:
LOT 1299, OF STONEYBROOK AT VENICE, UNIT 1, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
