NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale filed the 6 day of October, 2011, and entered in Case No. 36-2010-CA-050954, of the Circuit Court of the 20TH Judicial Circuit in and for Lee County, Florida, wherein BANK OF AMERICA NA is the Plaintiff and BARRY T. NEWMAN A/K/A BARRY NEWMAN; BANK OF AMERICA NA; LEE COUNTY, FLORIDA; PALM ISLES HOMEOWNERS ASSOCIATION INC.; UNKNOWN TENANT (S) A/K/A CHARLES STEVENS; ELLEN W. WITHINGTON A/K/A ELLEN WITHINGTON and UNKNOWN SPOUSE OF ELLEN WITHINGTON A/K/A ELLEN W. WITHINGTON IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.Lee.realforeclose.com at, 9:00 AM on the 9 day of November 2011, the following described property as set forth in said Final Judgment, to wit:

Lot 19, Block 6, of Unrecorded Tip Top Ilses, lying in Southwest Quarter (SW1/4) of Section 7, Township 46, South, Range 24 East, in Ft. Myers, Lee County, Florida as more patchouly described on the legal description attached hereto and made a part hereof.
A lot or parcel of land lying in the Southwest (SW1/4) of said Section 7 run S 89Ëš 24' 30” W along the South line of Section 7 for 590.44 feet: thence run N 00Ëš35'30” W perpendicular to said South lot line of said Section for 205.83 feet to a point on the curved south line of Home Avenue (50 feet wide) and the Point of Beginning of the herein described lot.
From said Point of Beginning run Northeasterly along the arc of a curve to the left a radius 75.00 feet (delta 33Ëš12'30”)(chord 42.86 feet) (chord bearing N 64Ëš14'30”E) for a distance of 43.47 feet, thence run S 47Ëš06'50” E for a distance of 208.15 feet to a Westerly line of Unit No 1 Tip Top Isles Plat Book 13, at page 146, Lee County, Public Records. Thence run S 00Ëš52'50” E along said W line a distance of .84 feet, thence S 89Ëš24'30”W parallel with said South line of Section 7 for 189.84 feet to an intersection with a line bearing S 00Ëš35'30” passing through the Point of Beginning: thence run N 00Ëš35'30” W for 125.83 feet to the Point of Beginning.
Subject to an easement 6 feet wide for drainage and public utilities over and across the Northwesterly 6 feet thereof.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
