NOTICE IS HEREBY GIVEN that pursuant to an Agreed Final Judgment of Mortgage Foreclosure on Count I entered on September 28, 2011, in that certain cause pending in the Circuit Court in and for Manatee County, Florida, wherein LPP MORTGAGE, LTD., is the Plaintiff, and MLG CAPITAL/FOUNTAINS LLC, ANDREW C. TESKE, ANDREW E. BRUCE, BRUCE N. WESTLING, TIMOTHY J. WALLEN and BARRY S. CHAVEN are the Defendants, Case No. 2011-CA-004526, R.B. Chips Shore, Clerk of Court, will at 11:00 a.m. on November 10, 2011, offer for sale and sell to the highest bidder for cash after giving notice as required by Section 45.031, Florida Statutes the following described property, situated and being in Manatee County, Florida by online sale at: www.manatee.realforeclose.com, to wit:
ALL OF THAT CERTAIN LOT, PIECE OR PARCEL OF LAND, WITH THE BUILDING AND IMPROVEMENTS THEREON, SITUATE, LYING AND BEING LOT 1, THE FOUNTAINS, ACCORDING TO THE MAP OR PLAT THEREOF, AS RECORDED AT PLAT BOOK 23, PAGES 122 THROUGH 124, INCLUSIVE, OF THE PUBLIC RECORDS OF MANATEE COUNTY, FLORIDA.
Said sale will be made pursuant to and in order to satisfy the terms of said Agreed Final Judgment of Mortgage Foreclosure on Count I. Any person claiming an interest in the surplus from said sale, if any, other than the property owner as of the date of the lis pendens, must file a claim within 60 days after the sale.
