NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Mortgage Foreclosure dated August 6, 2010 and entered in Case No. 2009 CA 009211 NC of the Circuit Court of the Twelfth Judicial Circuit in and for Sarasota County, Florida wherein DISTRESSED ASSET FUND, II, LLC, as successor-in-interest to BANK OF AMERICA, N.A., is the Plaintiff and DAVID M. CARLSON, an individual, MR. NAILS, INC., a Florida corporation, SOUTHWEST FLORIDA'S ORIGINAL CARLSON ROOFING, INC., a Florida corporation, DONALD D. PLATT, a lessee of property located at 920 South River Road, Englewood, FL, 34223 and ANY OTHER PARTY WHO MAY CLAIM AN INTEREST IN THE SUBJECT PROPERTY, are the Defendants, I will sell to the highest and best bidder for cash at www.sarasota.realforeclose.com at 9:00 a.m. or as soon as possible thereafter, on the 10th day of November, 2011, the following property as set forth in said Final Judgment:
Lot L, ENGLEWOOD GARDENS SUBDIVISION, UNIT 6, according to the plat thereof recorded in Plat Book 4, Page 74, of the Public Records of SARASOTA County, Florida, LESS the Northwesterly 200 feet thereof. Subject to an easement for ingress and egress over and across the Northerly 350 feet of said lot from the State Road to the excepted parcel of a width of 25 feet, ALSO LESS AND EXCEPT that portion of said Lot L conveyed to Sarasota County, a Political Subdivision of the State of Florida, in a Warranty Deed dated November 27, 1992 and recorded April 22, 1993 in Official Records Book 2499, Page 1793, of the Public Records of SARASOTA County, Florida.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
