NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Mortgage foreclosure dated October 13, 2011 and entered in Case No. 09-020028-CI-07 of the Circuit Court of the SIXTH Judicial Circuit in and for PINELLAS County, Florida wherein WHITNEY NATIONAL, a national banking association, and as successor by merger to SIGNATURE BANK is the Plaintiff and DAG BROS, INC., a Florida Corporation, JOSEPH DAGOSTINO, an individual, FRANK DAGOSTINO, an individual, ANTHONY DAGOSTINO, an individual. JOANI DAGNOSTINO, an individual, HUBBARD ENTERPRISES, INC., a Florida corporation, ARTHUR W. BROADERICK, an individual, and NORTHERN TRUST, N.A., a national banking association are the Defendants, I will sell to the highest and best bidder for cash in an online sale at www.pinellas.realforeclose.com beginning at 10:00 a.m. on November 30, 2011, described property as set forth in said Final Judgment:
Parcel 1:
Lot 6, Block 1, MITCHELL'S BEACH, according to the plat thereof, as recorded in Plat Book 3, Page 54, of the Public Records of Pinellas County, Florida.
Parcel 2:
Starting at the Southeast corner of Lot 4, Block 1, MITCHELL'S BEACH SUBDIVISION, according to the plat thereof, as recorded in Plat Book 3, Page 54, Pinellas County records, run thence Southeasterly along the Easterly side line of Lot 4, Block 1, mitchell's beach subdivision, extended to a point of intersection with the center line of 128th Avenue, said point of intersection being the Point of Beginning, run thence in a Southeasterly direction along the continued extension of the Easterly side line of Lot 4, Block 1, MITCHELL'S BEACH SUBDIVISION, to point of intersection with the Mean High Tide Line of John's Pass and calling this “Point A” for convenience, return to the Point of Beginning and run thence Southwesterly along the center line of 128th Avenue, to appoint of intersection with the Westerly side lot line extended of Lot 4, Block 1, MITCHELL'S BEACH SUBDIVISION, thence Southeasterly along the Westerly side lot line of Lot 4, Block 1, MITCHELL'S BEACH SUBDIVISION, further extended to appoint of intersection with the Mean High Tide Line of John's Pass, thence meandering to the Mean High Tide Line of John's Pass in a Northeasterly direction to Point “A”, all lying in and being part of Government Lot 2, Section 15, Township 31 South, Range 15 East, Pinellas County, Florida
AND
Lot 4, Block 1, MITCHELL'S BEACH SUBDIVISION, according to the plat thereof, as recorded in Plat Book 3, Page 54, of the Public Records of Pinellas County, Florida.
Parcel 3:
Lots 17 & 18, Block 1, MITCHELL'S BEACH, according to the plat thereof recorded in Plat Book 3, Page 54 of the Public Records of Pinellas County, Florida.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within sixty (60) days after the sale. Failure of any person claiming an interest in the surplus from the sale, other than the property owner, to file a claim within sixty (60) days after the sale will result in a loss of entitlement to surplus funds.
