NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale Filed the 7 day of September, 2011, and entered in Case No. 36-2009-CA-062872, of the Circuit Court of the 20TH Judicial Circuit in and for Lee County, Florida, wherein BAC HOME LOANS SERVICING, L.P. F/K/A COUNTRYWIDE HOME LOANS SERVICING, L.P. is the Plaintiff and KEVIN PELITERA, MORTGAGE ELETRONIC REGISTRATION SYSTEMS, INCORPORATED AS NOMINEE FOR COUNTRYWIDE BANK, N.A., VILLAGIO AT ESTERO CONDOMINIUM ASSOCIATION, INC., DEBRA PELITERA and UNKNOWN TENANT (S) A/K/A DREW LYONS IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.Lee.realforeclose.com at, 9:00 AM on the 7 day of October, 2011, the following described property as set forth in said Final Judgment, to wit:
UNIT 23-202, OF VILLAGIO, A CONDOMINIUM ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, AS RECORDED IN OFFICIAL RECORDS BOOK 4253, PAGE 4271, AS AMENDED IN OFFICIAL RECORDS BOOK 4253, PAGE 4397, AND AS FURTHER AMENDED FROM TIME TO TIME, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
