NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale filed the 8 day of September, 2011, and entered in Case No. 36-2010-CA-051127, of the Circuit Court of the 20TH Judicial Circuit in and for Lee County, Florida, wherein BAC HOME LOANS SERVICING, L.P. F/K/A COUNTRYWIDE HOME LOANS SERVICING, L.P. is the Plaintiff and DEREK L. BORNHORST; MANDONLIN BAY VILLAS CONDOMINIUM ASSOCIATION, INC.; MORTGAGE ELECTRONIC REGISTRATION SYSTEMS INCORPORATED AS A NOMINEE FOR COUNTRYWIDE HOME LOANS, INC.; UNKNOWN SPOUSE OF DEREK L. BORNHORST; JOHN DOE; JANE DOE AS UNKNOWN TENANT (S); IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.Lee.realforeclose.com, 9:00 AM on the 12 day of October, 2011, the following described property as set forth in said Final Judgment, to wit:
UNIT NO. 105, BUILDING A, OF MANDOLIN BAY VILLAS, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, AS RECORDED IN O.R. BOOK 4486, PAGE 4344, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA, TOGETHER WITH AN UNDIVIDED INTEREST IN AND TO THE COMMON ELEMENTS AS DESCRIBED IN SAID DECLARATION OF CONDOMINIUM AND INCLUDING BUT NOT LIMITED TO THE USE OF TWO AUTOMOBILE PARKING SPACES NUMBERED A- 105 BEING LIMITED COMMON ELEMENTS FOR SAID UNIT.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
