NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale dated the 31st day of May, 2011, and entered in Case No. 52-2010-CA-001280, of the Circuit Court of the 6TH Judicial Circuit in and for Pinellas County, Florida, wherein WELLS FARGO BANK, N.A. is the Plaintiff and DEBRA CUNNINGHAM A/K/A DEBRA E. CUNNINGHAM; BERMUDA BAY BEACH CONDOMINIUM ASSOCIATION, INC.; UNKNOWN HEIRS, BENEFICIARIES, DEVISEES, ASSIGNEES, LIENORS, CREDITORS, TRUSTEES AND ALL OTHERS WHO MAY CLAIM AN INTEREST IN “THE DEBRA E. CUNNINGHAM TRUST” (A REVOCABLE LIVING TRUST), DATED NOVEMBER 12, 2008; DEBRA A. CUNNINGHAM A/K/A DEBRA CUNNINGHAM, INDIVIDUALLY AND AS TRUSTEE OF “THE DEBRA E. CUNNINGHAM TRUST” (A REVOCABLE LIVING TRUST), DATED NOVEMBER 12, 2008; UNKNOWN SPOUSE OF DEBRA E. CUNNINGHAM A/K/A DEBRA CUNNINGHAM; UNKNOWN TENANT (S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash, on the 4th day of October, 2011, at 10:00 AM on Pinellas County's Public Auction website: www.pinellas.realforeclose.com in accordance with chapter 45, the following described property as set forth in said Final Judgment, to wit:
THAT CERTAIN CONDOMINIUM PARCEL CONSISTING OF UNIT C, BUILDING 4120, BERMUDA BAY BEACH CONDOMINIUMS, A CONDOMINIUM, TOGETHER WITH AN UNDIVIDED SHARE IN THE COMMON ELEMENTS APPURTENANT THERETO, IN ACCORDANCE WITH AND SUBJECT TO THE TERMS, CONDITIONS, COVENANTS, EASEMENTS, RESTRICTIONS AND OTHER PROVISIONS OF THAT CERTAIN DECLARATION OF CONDOMINIUM OF BERMUDA BAY BEACH CONDOMINIUMS, RECORDED IN OFFICIAL RECORDS BOOK 5416, PAGE 1159, ET SEQ., TOGETHER WITH ANY AND ALL EXHIBITS ATTACHED THERETO, AND AS MAY BE AMENDED FROM TIME TO TIME, AND ACCORDING TO THE PLAT THEREOF, AS RECORDED IN CONDOMINIUM PLAT BOOK 64, PAGE 74, ALL OF THE PUBLIC RECORDS OF PINELLAS COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
