Notice is hereby given that, pursuant to the Final Default Judgment - In Rem Lien Foreclosure entered in this cause on September 6, 2011, by the Honorable Edwin B. Jagger, Judge in the County Court of Pinellas County, Florida, the following property situated in Pinellas County, Florida, described as:
Unit/Lot No. 29 of ISLAND IN THE SUN CO-OP, INC., a Florida not-for-profit corporation, according to Exhibit“B” (the “Plot Plan”) of the Declaration of Master Form Occupancy Agreement recorded in O. R. Book 15155, Page 689, et seq., Public Records of Pinellas County, Florida (the “Master Agreement”), and as legally described in Exhibit“A” to said Master Agreement;
Commonly known as, Lot 29, 100 Hampton Road, Clearwater, Florida 33759, Parcel Number 17-29-16-43450-000-0290;
Together with any equity owned in said Unit or any assets of the ISLAND IN THE SUN CO-OP, INC., and including Membership Share Certificate #29, representing one (1) share in ISLAND IN THE SUN CO-OP, INC., and any other incident of ownership arising therefrom (the “Certificate”); and
Together with that certain 1990 PALM, Double-Wide Mobile Home, Title Numbers 60143003 and 60143004, and Vehicle Identification Numbers PH066193A and PH066193B (the “Mobile Home”) located on the Lot.
to the highest and best bidder, for cash, in an online sale at www.pinellas.realforeclose.com, beginning at 10:00 A.M. on Tuesday, October 11, 2011.
The sale is subject to the following paragraph contained in the Final Judgment entered in this action: “Any interest that may exist of Intervenor Stearns Bank, N.A., as successor in interest to First State Bank by asset acquisition from the FDIC as receiver for First State Bank (the “Bank”) in the Property, Memorandum, and Certificate is unaffected by this Final Judgment, and potential third party purchasers may take title subject to the Bank's alleged interest in the Property, Memorandum, and Certificate.”
Pursuant to §45.031(2)(f), Florida Statutes, please be advised that any person claiming an interest in the surplus from the sale, if any, other than the property owner must file a claim within 60 days after the sale.
