NOTICE IS HEREBY GIVEN pursuant to the Final Judgment of Foreclosure filed June 4, 2010 and entered in CASE NO.: 36-2009-CA-071164 in the Circuit Court in and for Lee County, Florida as well as pursuant to the Court's September 6, 2011 Order in the same case wherein The Bank of New York Mellon Trust Company, N.A. f/k/a The Bank of New York Trust Company, N.A., as Trustee for Chaseflex Trust Series 2007-2, is the Plaintiff and David G. Denkhaus a/k/a David Denkhaus; Diane L. Denkhaus; Comerica Bank; Belle Lago Homeowners Association, Inc.; are the Defendants, I will sell to the highest and best bidder for cash in accordance with Section 45.031, Florida Statutes, at: www.lee.realforeclose.com, the Clerk's website for on-line auctions, at 9:00 a.m. on the 7th day of October, 2011, the following described property as set forth in the Final Judgment, to wit:
LOT 357, BELLE LAGO, PHASE TWO, A SUBDIVISION ACCORDING TO THE PLAT THEREOF, RECORDED IN PLAT BOOK 82, PAGES 98 THROUGH 102, INCLUISVE, FO THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within sixty (60) days after the sale.
