NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure filed September 21st, 2011, and entered in Case No. 2008 CA 10283 DIV D, of the Circuit Court of the 12th Judicial Circuit in and for MANATEE County, Florida. DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE OF THE INDYMAC INDX MORTGAGE LOAN TRUST 2006-AR39, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2006-AR39 UNDER THE POOLING AND SERVICING AGREEMENT DATED DECEMBER 1, 2006 is Plaintiff and TONY TOLEDO; UNKNOWN SPOUSE OF TONY TOLEDO; MARC MAILLOUX; UNKNOWN PERSON(S) IN POSSESSION OF THE SUBJECT PROPERTY; BRIAN R. SIROIS; A & P RICH, INC.; are defendants. The Clerk of Court will sell to the highest and best bidder for cash by electronic sale at: www.manatee.realforeclose.com, at 11:00 a.m., on the 29th day of December, 2011, the following described property as set forth in said Final Judgment, to wit:
Lot 4, MANATI SHORES, a Subdivision, According to the plat thereof as recorded in Plat Book 8, Page 67, of the Public Records of Manatee County, Florida. Together with the following described parcel of land: Commence at the Northwest corner of the aforementioned Lot 4; thence S89Degree 48'04”E, along the North line of Lot 4, a distance of 70.05 feet for a point of Beginning; thence continue S89Degree 48'04”E, 40.00 feet; thence South, 20.00 feet; thence N89'48'04”W, 40.00 feet; thence North 20.00 feet to the Point of Beginning.
A person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim with 60 days after the sale.
