notice is hereby given pursuant to an Order or Final Judgment of Foreclosure dated April 9, 2012, and entered in Case No. 200908937CA of the Circuit Court of the 20th Judicial Circuit in and for Collier County, Florida, wherein THE BANK OF NEW YORK MELLON F/K/A THE BANK OF NEW YORK, AS TRUSTEE FOR THE HOLDERS OF THE CERTIFICATES, FIRST HORIZON MORTGAGE PASS-THROUGH CERTIFICATES SERIES 2005 AA10, BY FIRST HORIZON HOME LOANS, A DIVISION OF FIRST TENNESSEE BANK NATIONAL ASSOCIATION, THE MASTER SERVICER, IN ITS CAPACITY AS AGENT FOR THE TRUSTEE
UNDER THE POOLING AND SERVICING AGREEMENT is the Plaintiff and DREW R. FESSLER; and UNKNOWN SPOUSE OF DREW FESSLER nka NANCY FESSLER; and VANDERBILT TOWERS, UNITE #3 OF NAPLES, INC. the Defendants, I will sell to the highest and best bidder for cash on the first floor, atrium, of the Collier County Courthouse, 3315 Tamiami Trail East, Naples, FL 34112, at 11:00 A.M. on the 10 day of May, 2012, the following described property as set forth in said Order of Final Judgment, to wit:
UNIT 311 AND 411, VANDERBILT TOWERS UNIT 3, A CONDOMINIUM ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF AS RECORDED IN OFFICIAL RECORDS BOOK 467, PAGE 638 THROUGH 686, AS AMENDED AND RESTATED IN OFFICIAL RECORDS BOOK 1803, PAGES 647, AND SUBSEQUENT AMENDMENTS THERETO, OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK OF COURT NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
