NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure filed the 26 day of July, 2012, and entered in Case No. 36-2011-CA-052411, of the Circuit Court of the 20TH Judicial Circuit in and for Lee County, Florida, wherein FINANCIAL FREEDOM ACQUISITION LLC is the Plaintiff and CHRIS LABOUNTY, BEACH CLUB COLONY CONDOMINIUM ASSOCIATION, INCORPORATED, SECRETARY OF HOUSING AND URBAN DEVELOPMENT, PEGGY AKEY, TIM LABOUNTY, JANE O'ROURKE, UNKNOWN CREDITOR(S) OF THE ESTATE OF NANCY J. LABOUNTY and UNKNOWN HEIRS AND/OR BENEFICIARIES OF THE ESTATE OF NANCY J. LABOUNTY and UNKNOWN TENANT IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.Lee.realforeclose.com at, 9:00 AM on the 29 day of August, 2012, the following described property as set forth in said Final Judgment, to wit:
LOT 712, KNOWN AS CONDOMINIUM UNIT NO. 712, LEHIGH ACRES BEACH CLUB COLONY CONDOMINIUM INCORPORATED A CONDOMINIUM, ALL AS SET OUT IN DECLARATION OF CONDOMINIUM AND EXHIBITS ATTACHED THERETO, RECORDED IN O.R. BOOK 677, AT PAGE 208-246, PUBLIC RECORDS OF LEE COUNTY, FLORIDA, AND AS DESCRIBED BY THE PLANS THEREOF RECORDED IN CONDOMINIUM PLAT BOOK 2, PAGE 64, PUBLIC RECORDS OF LEE COUNTY, FLORIDA. ABOVE DESCRIPTION AND CONVEYANCE INCLUDES, BUT IS NOT LIMITED TO ALL APPURTENANCES TO LOT 712, ALSO KNOWN AS CONDOMINIUM UNIT NO. 712 ABOVE DESCRIBED, TOGETHER WITH ALL IMPROVEMENTS THEREON AND TOGETHER WITH THE UNDIVIDED INTEREST IN THE COMMON ELEMENTS OF THE AFORESAID CONDOMINIUM PERTINENT TO SAID UNIT.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
